1. Agreement to these Terms
These Terms of Service ("Terms") govern your use of the Voyant mobile application, website, and related services (collectively, the "App"). By creating an account, downloading, installing, or otherwise using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the App. By using the App you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
3. Your account
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access. You may delete your account at any time from Settings → Account → Delete Account; this permanently removes your profile, moments, journal entries, and connected wearable tokens.
You do not need an account to use Voyant at a participating hotel or gallery. Scanning a venue code creates a guest session, with no name, email, or password. That session is anonymous to us. It is recorded on our servers so it can be scored and played back to you during your visit, but because it carries nothing that identifies you, we cannot reunite you with it once the guest session ends or the app's data is cleared. If you would like to keep your sessions, you can add an email address at any time; doing so converts that same session into an account and preserves everything already recorded under it.
4. Wellness app, not medical advice
The App is a wellness and self-reflection tool. It is not a medical device and is not intended to diagnose, treat, cure, mitigate, or prevent any disease, medical condition, or mental-health condition. Scores, insights, breath-pacing guidance, and recommendations are informational only and are based on patterns in self-reported and optional wearable data. The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare professional with any questions about your health or a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read or experienced in the App. Do not use the App in place of medical care, and do not use immersion moments while driving, operating machinery, or in any context where reduced alertness could cause harm. If you are experiencing a medical or mental-health emergency, call your local emergency number immediately.
5. HealthKit and wearable integrations
If you choose to grant the App access to Apple Health (HealthKit) or to connect a third-party wearable (Oura, WHOOP, Google Health, or Apple Watch), you authorize the App to receive the data types described at the time of consent. You may revoke access at any time in iOS Settings or in the App. Health and wearable data is used solely to personalize your moments and insights. We do not use HealthKit data for advertising or marketing, and we never sell health or wearable data to third parties.
6. Subscriptions and pricing
Voyant Premium is not offered for purchase in the current release; access to the App is available to anyone who creates an account, and through a participating venue. The terms below apply if and when a subscription is made available to you. Voyant offers a free tier and an optional auto-renewable subscription. New subscribers receive a 3-day free trial; unless cancelled at least 24 hours before the trial ends, the subscription begins automatically and renews at the selected interval until cancelled. Billing is handled by the Apple App Store; manage or cancel anytime from Settings → Apple ID → Subscriptions on your iPhone. Deleting the App does not cancel a subscription. Sessions provided through a participating venue, and the ZeroPoint score itself, remain available without a subscription.
7. Venue access and artwork
Some hotels, galleries, and exhibitions license Voyant for their guests and visitors. Where they do, a code displayed beside an artwork opens a session for that specific piece at no cost to you and without an account. Access of this kind is provided by the venue, is limited to the artwork and the setting in which it is offered, and may be changed or withdrawn by that venue at any time. It confers no rights to the wider App.
The photographs in Voyant are original works and are sold as physical prints through a separate storefront operated on the web. Those are purchases of physical goods, made outside the App and governed by that storefront's own terms. Buying a print does not grant, extend, or alter any access, subscription, or feature within the App, and the App neither offers nor links to those purchases.
8. Acceptable use
You agree not to: (a) reverse-engineer, decompile, or attempt to extract source code from the App; (b) interfere with or disrupt the App's operation; (c) scrape, harvest, or collect data from the App; (d) use the App to harass, abuse, or harm others; or (e) use the App in violation of any applicable law.
9. Intellectual property
The App and all associated content, trademarks, logos, software, audio, scoring algorithms, and designs are owned by Voyant or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial wellness purposes.
10. User content
Any journal entries, reflections, or other content you create in the App ("User Content") remain yours. You grant us a limited license to store, process, and display your User Content solely to operate the App for you. We do not use your User Content to train third-party AI models.
11. Privacy
Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
12. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the App in a way that risks harm to you, others, or the service.
13. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of liability
To the fullest extent permitted by law, Voyant and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
15. Changes to the App or these Terms
We may modify or discontinue features at any time, and we may update these Terms from time to time. Material changes will be communicated in the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of the jurisdiction in which Voyant is established, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, except where applicable consumer protection law provides otherwise.
